Although not specifically identified as the non-Federal sponsor for the project, the City of Martin is the primary beneficiary of the project and is the prime stakeholder with regard to the long term quality, durability, reliability and sustainability of the project. The Mayor and City Council of Martin are the prime coordinators with the Corps of Engineers regarding decisions made during the planning, engineering, design and construction of the project. This responsibility has been informally transferred to the City of Martin by the Floyd County Fiscal Court. As a municipal government in Kentucky, the City of Martin is responsible for the care, protection and welfare of the citizens within its incorporated community and assurance that the fiscal capability of the community is sustained into the future.

The Floyd County Fiscal Court is the official non-Federal Sponsor for the City of Martin Redevelopment Project and executed the Project Cooperation Agreement for the project. In this capacity, the Floyd County Fiscal Court has taken the responsibility for securing the Lands, Easements, Right-of-ways, Relocations and Disposal areas (LERRD) for the project as well as assuming the financial support of the capital construction cost of the project and has accepted the long-term operation and maintenance responsibility for the project. The day-to-day operation and maintenance of the project features being constructed in the City of Martin will eventually be transferred by a sub-agreement to the municipal government of Martin. The Floyd County Fiscal Court is working closely with the Corps of Engineers and the City of Martin in the implementation of the project.

The Commonwealth of Kentucky has assumed the role of a financial sponsor/contributor for the Town of Martin project. Given the legal requirement for non-Federal cost sharing in flood protection projects, the Commonwealth’s General Assembly, knowing the limited financial capability of the counties and municipalities in Kentucky, determined that the state government itself must be a partner in the development of projects which protect the citizens of Kentucky. In the Town of Martin project, the Commonwealth of Kentucky working through its Department of Local Governments is providing 95 percent of the non-Federal share (5 percent) of the project. In addition to the role of financial contributor, the Commonwealth of Kentucky through its water resources protection agencies is responsible for evaluating Corps permit applications for project construction at Martin and issuing said permits to further the Corps’ construction activities.

The Corps of Engineers is the nation’s premier public engineering agency charged by Congress with the responsibility of protecting and developing the water resources of our nation. The Huntington District of the Corps of Engineers is responsible for administering the flood protection, navigation and ecosystem restoration programs within 5 states associated with the Ohio River drainage basin. The Big Sandy River Basin of which Beaver Creek is a tributary, is within the administrative jurisdiction of the Huntington District. In accordance with legislative language provided by Congress in 1980, the Huntington District was given the responsibility for identifying and implementing flood damage reduction measures in Floyd County and in particular the Town of Martin. Based upon the Detailed Project Report for the Town of Martin produced in March 2000 and the Project Cooperation Agreement executed in XXXX, the Corps of Engineers is the Federal partner in development of the project and will be the primary planning, engineering and construction agency during the implementation of the project. The application of Federal funds for the project will primarily come through the Corps of Engineers.
